Terms of Service

1. The Service

FitLogs ("we", "us", "our") is an SMS-based health tracking service operated by Athens Innovation and Development LLC. The service allows you to log food intake, physical activity, body progress observations, and health routines via text message, and access your logged data through a web dashboard.

2. SMS Consent and Opt-In

By texting 1-888-596-5467, you expressly consent to receive SMS messages from FitLogs in response to your messages. These messages include:

• AI-generated nutrition estimates in response to food photos
• AI-generated body progress observations in response to check-in photos
• Confirmations of logged health data (steps, sleep, hydration, routines)
• Welcome messages and usage instructions

Message and data rates may apply. Message frequency varies based on your usage. Text STOP at any time to unsubscribe. Text HELP for support.

3. Photo Analysis and Data Storage

Photos and videos are never stored by FitLogs under any circumstances. This is enforced at the application and database level — our storage layer explicitly rejects any binary or image data regardless of how it is submitted.

When you send a photo or video via SMS or upload one through the dashboard, the following occurs:

• The image is transmitted directly to Anthropic's Claude AI for analysis
• The image exists in memory only during the analysis — it is never written to disk or any database
• After analysis the image is immediately and permanently discarded
• Only the AI-generated text analysis results are returned to you for review
• Only the text values you explicitly confirm are saved to your account

Third-party image content. If you send images containing other individuals, nudity, or any content that violates Anthropic's usage policies, that content is governed exclusively by Anthropic's Terms of Service and Usage Policy. FitLogs is not a party to the transmission between your device and Anthropic's API, does not store such content, and assumes no legal responsibility for content transmitted during the analysis process. You agree not to send images of other individuals without their explicit consent, or any content that violates applicable laws or Anthropic's usage policies.

4. Not Medical Advice

FitLogs is a personal tracking tool, not a medical service. Nothing in the service constitutes medical advice, diagnosis, or treatment. AI-generated calorie estimates and body progress observations are approximations for personal tracking purposes only. Always consult a qualified healthcare provider for medical guidance.

5. Account and Eligibility

You must be at least 18 years old to use FitLogs. By using the service you represent that you meet this requirement. You are responsible for maintaining the confidentiality of your account credentials.

6. Acceptable Use

You agree not to use FitLogs to:

• Send photos that are obscene, illegal, or violate the rights of others
• Attempt to reverse engineer, disable, or interfere with the service
• Use the service for any purpose other than personal health tracking
• Impersonate another person or entity

7. Subscription and Billing

FitLogs offers free and paid subscription tiers. Paid subscriptions are billed monthly. You may cancel at any time and retain access through the end of the billing period. Refunds are not provided for partial months.

8. Limitation of Liability

To the maximum extent permitted by law, Athens Innovation and Development LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of FitLogs. AI-generated estimates are provided as-is without warranty of accuracy.

9. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via SMS. Continued use of the service after changes constitutes acceptance of the updated terms.
